A Marriage Based Green Card, also known as an Adjustment of Status (AoS), is a process that allows a foreign national who is married to a U.S. citizen to apply for a green card (lawful permanent residency) while living in the United States.
To be eligible for an Adjustment of Status (AoS), you must be married to a U.S. citizen and your marriage must be legally recognized in the United States. You must also be able to demonstrate that you have a bona fide intention to live with your spouse in the United States and that you have a genuine marital relationship.
To apply for a Marriage Based Green Card, you will need to complete Form I-485, the Application to Register Permanent Residence or Adjust Status, and Form I-130, the Petition for Alien Relative. You will also need to pay the application fee and gather supporting documents, such as proof of your marriage and your spouse’s U.S. citizenship, proof of your relationship, and evidence of your eligibility for a green card.
If your Adjustment of Status application is approved, you will be granted lawful permanent residency in the United States and will be issued a green card. This will allow you to live and work in the United States indefinitely, as long as you maintain your lawful permanent resident status.
